TERMS OF USE AGREEMENT & CONDITIONS (AGBs)

Welcome to tassel-tales.com. This site is hosted by Tassel Tales OG.

These Terms & Conditions (hereinafter) of
Tassel Tales OG, Hollandstrasse 8/23, 1020 Vienna, Austria.

(hereinafter: Tassel Tales OG) are considered to be contract partner for all orders in the online shop under www.tassel-tales.com. The customer has the responsibility to view the terms and conditions during the ordering process, print and save them.

1. ACCEPTANCE
By using the site, you agree to be legally bound by all the terms and conditions contained in the Terms of Use Agreement (“Agreement”). Please read these terms carefully. By using this site, you also represent that you are at least 18 years old, or you are at least the minimum legal age to enter into a contract in the jurisdiction in which you are using the site. In addition, when you use any current or future version of the website, you also will be subject to the terms and conditions of this Agreement. Please print a copy of this Agreement for your records. We may, from time to time, modify the terms of this Agreement. When we make changes, we will post those changes here. Your use of the tassel-tales.com site following any such modification constitutes your agreement to the terms of the modified Agreement.

2. CONTRACTING PARTY, LANGUAGE, APPLICABLE LAW
The contracting party is Tassel Tales OG, Hollandstrasse 8/23, 1020 Vienna, Austria. The contract language is English. Austrian law is applicable, excluding UN convention or contracts for the international sale of goods.

3. PRODUCTS
3.1. All tassel-tales.com products are offered only for private consumer use and not for commercial distribution. We only accept orders that are made via the online store. Orders by fax, email or letter will not be accepted and will not be processed.

3.2. Tassel Tales has taken reasonable steps to ensure that the information contained in this web site is accurate; however, all information is provided "as is" without any express or implied warranties. We take all reasonable care to ensure that all product descriptions are correct. Unless otherwise expressly stated, the site contents, products and services are provided on an “as is” basis.

3.3. Pictures on tassel-tales.com are for reference only and are not legally binding. We take all reasonable care to display our products as accurately as possible. What you see depends on your computer equipment, screen or monitor and we are therefore unable to guarantee that the product images are an accurate representation of the actual product. Please refer to our return policy if you are unhappy with your order.

3.4. The website features products that are for sale. Products are subject to availability. Once the product is sold out, it will be taken off the website at the earliest opportunity or it will be mentioned accordingly online and may not be available again. If a product you have ordered is out of stock at time of order acceptance, Tassel Tales will not be liable for filling that order. If such a situation arises, we will notify you as soon as possible and you will not be charged for the out-of-stock product.

3.5. Product prices are shown in Euros and include the value added tax (VAT). Product prices shown on the website may change from time to time.
Additional charges such as taxes, duties, fees, levies or shipping costs may apply based on the country of destination.

3.6. The prices displayed at www.tassel-tales.com include the statutory Value Added Tax but do not include shipping costs. If the VAT rate applicable on the date of the order is different from the rate at the time of shipment, that change will be reflected on the invoice without further notice.

Shipping cost calculations are defined in the Shipping&Returns section of this website and, if we are unable to ship your order in full, there will be no additional charge for partial shipment(s) of the same order.

3.7. If a Tassel Tale product or service is listed at an incorrect price due to a typographical error or error in pricing information, Tassel Tales shall have the right to refuse or cancel any orders placed for any product or service listed at the incorrect price. Tassel Tales will have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Tassel Tales will issue a credit to your credit card account in the amount originally charged.

4. CONCLUSION OF CONTRACT
All agreements between Tassel Tales and the customer in connection with an order are governed by the terms of agreements. By placing your order you agree to the terms and conditions of this website. Any order placed by you binds you immediately to the terms and conditions of Tassel Tales. Therefore, prior to placing your order with us, read carefully and understand the terms and conditions of Tassel Tales. Any conditions imposed by the customer, which conflict with the terms of this Agreement are not binding.

The ordering process is initiated by the customer by placing the online store products in the virtual “Shopping Cart”. Entered data may be changed by the customer until the completion of the order which is achieved by clicking the “Buy” button.
Tassel Tales will provide an immediate email acknowledging the order (order receipt)
After review and acceptance of the order, Tassel Tales will send an order confirmation and shipment notification via email which includes description of the items ordered, shipment details and preliminary invoice.

5. AGREEMENT ON COSTS OF RETURN, ORDER CANCELATION AND EXEMPTION
5.1. Order cancelation prior to shipment
You may cancel your order at any time prior to shipment without penality. You need to inform us via email at  hello@tassel-tales.com.

5.2. Order cancelation after shipment
Please refer to Retuns&Exchanges policy section of this website.

5.3. Payment/Credits after return
No credit will be issued until the goods are received by Tassel Tales or proof of shipment is provided, whichever is earlier. The 14 day return policy applies.

5.4. Exemption
Any returned items that are damages will not be refunded at full value.

5.5. Return of order
Please refer to Shipping & Returns policy section of this website.

6. DELIVERY
Unless agreed upon prior to shipment, shipment is made from the tassel-tales.com warehouse to the shipping address provided by the customer.

6.1. Normal delivery is expected within 3 to 10 business days after order confirmation unless stated differently in the online store. Occasionally, delivery may take longer due to events beyond our control. All parcels will be delivered by GLS and require a signature upon delivery. In the unlikely event the delivery time by GLS exceeds 30 days, you may cancel your order by contacting hello@tassel-tales.com for a full refund.

6.2. Ordered items are shipped to the shipping address provided by the customer. The customer must provide us with complete and accurate name and shipping address. Tassel Tales is not liable for the delivery of your order to a wrong address or wrong person that has been specified by the customer while placing the order.
If the customer provides us with a wrong address or name, he/she will be held financially responsible for that order.

6.3. Note that the delivery time of your order may vary or take longer during sales or busy periods.

6.4. In case ordered items are out-of-stock and result in shipping delays, Tassel Tales will inform the customer directly via e-mail. In such a case, if accepted by the customer, we will ship partial orders. Any resulting additional shipping costs shall not be borne by Tassel Tales.

7. WARRANTY, GUARANTEES AND CUSTOMER SERVICE
7.1. The statutory warranty regulations apply. If the delivered goods are defective, the customer has the right to choose between replacement at no charge or credit for the defective product less shipping costs.

7.2. Deviations in material, quality, color, size, cut or design of the product are unavoidable and irrelevant. Warranty rights do not exist for such variances. However the customer is free to prove that deviations are excessive and bring them to Tassel Tales’ attention for consideration.

7.3. Warranty rights are voided if the goods have been altered, modified or damaged by the customer or a third party.

8.1. The listed trademarks and brand names are the intellectual property of their respective owners.

8.2. The contents of the website under www.tassel-tales.com, in particular texts, fashion designs, graphics, logos, illustrations, slogans, photographs, images, moving images, sound and video recordings and software are the intellectual property of Tassel Tales, unless they are copyrighted by third parties. Reproductions, adaptations, translations and other processing of content, including the use of content are NOT permitted.

9. LIABILITY
9.1. Tassel Tales’ liability shall be limited to statutory provisions except as follows:

9.2. In the event that we are prevented from fulfilling our obligations due to a force majeure or other circumstances beyond our control, we assume no liability. If cases of force majeure or other circumstances beyond our control lead to a delay, we will fulfill our obligations as soon as it is reasonably is possible under the circumstances.
9.3. Tassel Tales is not responsible for any losses caused by circumstances beyond its control including, but not limited to, fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity. Our maximum liability to you related to your order on www.tassel-tales.com shall be limited to the total price of that order.

10. PRIVACY
Privacy matters. Tassel Tales recognizes the importance of our customers’ privacy, and takes the following steps to protect that privacy.

10.1.We don’t share private information. The above statement does not include the privacy practices for partnered sites or for sites visited from links shown on tassel-tales.com.  We encourage our customers to read the privacy statements of those sites, as their privacy practices may differ from ours. This privacy statement applies only to this site and does not necessarily apply to off-site information.

10.2. We save, process and use the personal data you provide on the order form to fulfill the order. Your privacy is of utmost importance to us and your personal information will be stored and safeguarded in our data base.

10.3. We give some information to the contracted shipping companies for the execution of the order. For the settlement of payment, Tassel Tales will transfer the payment data of the customer, if necessary, to the bank or payment service provider of Tassel Tales.

11. PAYMENT
You can pay for your goods in various ways as set out below.

11.1. Credit Card. You will enter your payment details at the time you place your order using a valid credit card (VISA or Mastercard). The applicable amount will immediately be reserved on your card but will not be debited until the goods are shipped. Tassel Tales reserves the right to check the validity of the credit card, its credit status in relation to the order value and whether the address data of the purchaser is correct. We may refuse orders depending on the result of these checks.

11.2. Pay Pal. When paying by PayPal, Tassel Tales reserves the right to check the validity of the PayPal account, confirm there are sufficient funds to cover the purchase amount, and validate the billing address details of the purchaser. Tassel Tales reserves the right to deny any purchase. Your PayPal account will only be debited after your order has been shipped from the warehouse. The currency used is Euro (€) for all countries. VAT is included in all our prices and will be updated on the online store when you select shipping country.

Wenn Sie per Formular auf der Website oder per E-Mail Kontakt mit uns aufnehmen, werden Ihre angegebenen Daten zwecks Bearbeitung der Anfrage und für den Fall von Anschlussfragen sechs Monate bei uns gespeichert. Diese Daten geben wir nicht ohne Ihre Einwilligung weiter.
 
3. DATENSPEICHERUNG

Wir weisen darauf hin, dass zum Zweck des einfacheren Einkaufsvorganges und zur späteren Vertragsabwicklung vom Webshop-Betreiber im Rahmen von Cookies die IP-Daten des Anschlussinhabers gespeichert werden, ebenso wie Name, Anschrift und Kreditkartennummer […] des Käufers.

Darüber hinaus werden zum Zweck der Vertragsabwicklung folgende Daten auch bei uns gespeichert: [bitte Daten ergänzen]. Die von Ihnen bereit gestellten Daten sind zur Vertragserfüllung bzw zur Durchführung vorvertraglicher Maßnahmen erforderlich. Ohne diese Daten können wir den Vertrag mit Ihnen nicht abschließen. Eine Datenübermittlung an Dritte erfolgt nicht, mit Ausnahme der Übermittlung der Kreditkartendaten an die abwickelnden Bankinstitute / Zahlungsdienstleister zum Zwecke der Abbuchung des Einkaufspreises, an das von uns beauftragte Transportunternehmen/Versandunternehmen zur Zustellung der Ware sowie an unseren Steuerberater zur Erfüllung unserer steuerrechtlichen Verpflichtungen.

Nach Abbruch des Einkaufsvorganges werden die bei uns gespeicherten Daten gelöscht. Im Falle eines Vertragsabschlusses werden sämtliche Daten aus dem Vertragsverhältnis bis zum Ablauf der steuerrechtlichen Aufbewahrungsfrist (7 Jahre) gespeichert.  

Die Daten Name, Anschrift, gekaufte Waren und Kaufdatum werden darüber hinaus gehend bis zum Ablauf der Produkthaftung (10 Jahre) gespeichert.  Die Datenverarbeitung erfolgt auf Basis der gesetzlichen Bestimmungen des § 96 Abs 3 TKG sowie des Art 6 Abs 1 lit a (Einwilligung) und/oder lit b (notwendig zur Vertragserfüllung) der DSGVO.  
 
4. COOKIES

Unsere Website verwendet so genannte Cookies. Dabei handelt es sich um kleine Textdateien, die mit Hilfe des Browsers auf Ihrem Endgerät abgelegt werden. Sie richten keinen Schaden an.
